Internship Agreement

General

  1. The Data Analytics Institute has agreed to offer the Intern an unpaid internship ('Internship') under the following terms and conditions.

  2. The Intern has accepted The Data Analytics Institute's offer on the terms and conditions set out in this Agreement.


Definitions and Interpretation

Confidential Information includes all information provided by The Data Analytics Institute to the Intern of any nature and in any form

  1. all the terms of this Internship Agreement and its subject matter;

  2. all information, whether disclosed directly or indirectly, related to The Data Analytics Institute's business, products, and services (including future products and services), financial information, Intellectual Property Rights, technology, trade secrets, know-how, proprietary information, client lists, contracts and arrangements, plans, strategies and forecasts, research and development information, letters and papers of every description (and copies and extracts made of or from such information); 


and including without limitation information that is not specifically marked or identified as such would reasonably be regarded as secret commercial information of the owner but does not include:

  1. any information that was lawfully known to or in the Intern's possession or control without restriction prior to the Intern performing the Internship; or

  2. any information that is in the public domain other than as a result of a breach of this agreement or other obligation of confidence.


Intellectual Property means inventions, know-how, patents, registered and unregistered trademarks, service marks, registered and unregistered designs, copyrights, circuit layouts, domain names, internet addresses, computer programs, confidential information, trade secrets, trade or business names and brand names;

Intellectual Property Rights means all intellectual and industrial property rights, including without limitation copyright, trademarks or trade names, patents, designs (whether registered or pending registration), goodwill, trade secrets, secret processes, moral rights, the right to have confidential information kept confidential and other like rights whether arising by common law or by statute;

Nature of the Internship

  1. The Data Analytics Institute and the Intern agree that the Internship is a work experience only. The Intern is not an employee of The Data Analytics Institute or the host company at any time or for any purpose.

  2. The Intern will receive no payment for performing any work during the Internship and will not, for any purpose, become an employee of The Data Analytics Institute or the host company as a result of performing the Internship.

  3. An internship is voluntary.

  4. To offer training, experience, and skill development for a person while allowing them to gain experience in a job or industry.

  5. There is no involvement in any client or productive work, and the project work is never monetized directly or indirectly.

  6. It will not involve work that is for the operational benefit of the business or the host company.

  7. The main benefit is the person undertaking the role, not the host company.


Term of the Internship 

  1. The duration of the Internship varies from 4 weeks up to 12 weeks.

  2. The Internship may not be extended beyond the Cessation Date except by further agreement in writing executed by the intern & the host company.


Intern obligations and acknowledgments

The Intern agrees and acknowledges the Intern's obligation to:


  1. Use the best of the Intern's abilities and act in the best interest of The Data Analytics Institute and the host company for the duration of the Internship;

  2. Participate in any training required by the host organization.

  3. Comply with the host organization’s workplace rules and requirements for safety and behavior.

  4. Follow all lawful and reasonable instructions of the host organization.

  5. Refrain from any conduct that would adversely reflect on the host company or The Data Analytics Institute

  6. Not engage in any activity which is incompatible with the aims and objectives of the host company

  7. comply with any and all legislation, codes, or guidelines, in whatever form, that are applicable to the Intern; 

  8. Undergo any and all training that the host company deems necessary to enable the Intern to safely and efficiently perform the Intern's duties during the Internship.

  9. Notify the host organization supervisor as soon as possible if you are unable to attend the internship at any of the agreed times.

  10. All Intellectual Property Rights developed by the Intern while the Intern is performing the Internship under Internship are assigned to and vested in the host company as created.

  11. The host company owns and retains all rights at all times to the host company or The Data Analytics Institute.

  12. The intern can choose to work on a part-time or full-time basis. The arrangement will have to be discussed upfront with the intern’s internship manager/supervisor before your internship activity can begin. Any changes to the intern's or host company’s circumstances will have to be communicated to the other party before any changes to work arrangements are made.

  13. The intern will need to complete at least 30 days of internship to receive a referral of any kind (written, email, or phone). 1-day equates to 8 hours' worth of work to produce agreed deliverables as per your discussion with your internship manager/supervisor. The number of days worked is determined by your internship manager/supervisor at his/her sole discretion.


Confidentiality

Unless the Intern has previous written consent from the host company, the Intern:


  1. The Intern will keep confidential any and all Confidential Information of the host company that comes into the Intern's possession;

  2. Must at all times store all Confidential Information safely and securely;

  3. Must not use information gained in the course of the Internship to cause harm or detriment to the host company, any person, or body;

  4. Shall not remove the confidential information from the premises of the host company;

  5. Must immediately notify the host company in writing of any actual, threatened or suspected unauthorized disclosure of any Confidential Information.

Termination of Internship

  1. The Intern accepts that the internship may be terminated prior to the Cessation Date at the host company’s sole discretion.

  2. The host company may, but is under no obligation to, discuss future employment opportunities with the Intern.


Jurisdiction

This Internship Agreement is governed by the laws of New South Wales (NSW) and the parties submit to the exclusive jurisdiction of the courts of New South Wales.

Internship Duties

  • Make first contact within 10 working days after the final project presentation

  • At least one catch-up every week with your internship supervisor (time and day of the week to be mutually agreed upon)

    • Two unexcused absences will lead to the termination of the internship

  • Up to a 4-week break can be granted for holidays, health issues, study breaks, or other commitments

    • Written permission is required from Internship In-case a break is required

  • If a meeting cannot be attended, provide ample notice, and reschedule the appointment as soon as possible

  • Punctuality - interns are to dial into the meeting at least 5 minutes before the start time. If running late, let your supervisor know

  • Communication - interns are expected to respond to their supervisor at their earliest convenience. The response should be 24 hours at the latest.

  • Work hours are flexible and should be discussed with your supervisor beforehand

  • Feedback and improvement: Always seek feedback on your work

  • Confidentiality: When working with confidential data adhere to the confidentiality or NDA policy of the internship company

  • Professionalism: Maintain a professional attitude at all times.

  • Complete the project as per direction from the internship (only on successful completion will reference services be provided)

  • Document everything about your project

  • If you wish to terminate the internship before it ends please let your internship supervisor know and handover all work

  • Accept and adhere to the terms and conditions and this Internship Agreement

Confidentiality

References

To receive a reference, interns must meet the following expectations:


  1. The intern needs to successfully complete the entire 12-week internship program.

  2. Demonstrate a positive work ethic and attitude that aligns with company's core values and principles, This includes, but is not limited to, being reliable, responsible, and a team player.

  3. Successfully complete and submit a minimum of 2 assigned projects to a satisfactory standard.

  4. Successful interns will receive both written and verbal references upon request. These references will be provided by the intern's host company and will highlight the intern's performance, contributions, and overall impact during the internship.


Jurisdiction

This Internship Agreement is governed by the laws of New South Wales (NSW) and the parties submit to the exclusive jurisdiction of the courts of New South Wales.
